Privacy Policy

This privacy policy (“Privacy Policy” or “Policy“) helps you understand how LBJ Infrastructure Group LLC, d.b.a. LBJ Express/LBJ TEXpress Lanes and NTE Mobility Partners/NTE Mobility Partners Segments 3, d.b.a. North Tarrant Express/NTE TEXpress Lanes and its affiliates (collectively referred to in this policy as “TEXpress Lanes”, “we”, “us”, or “our”) collect, store, use, process and share your personal information when you use the TEXpress Lanes website (the “Website”). The TEXpress Lanes system is a network of government-operated and privately-operated highway corridors.

This policy does not apply whenever visitors leave the TEXpress Lanes website and follow a link to another site, including the sites of state agencies and local governments.  By accessing the TEXpress Lanes Website, you agree your Personal Information, as defined below, will be handled as described in this Policy. Your use of our Website, and any dispute over privacy, is subject to this Policy and our  Terms of Use (https://www.texpresslanes.com/terms/), including its applicable limitations on damages and the resolution of disputes. The Terms of Use are incorporated by reference into this Policy.  

1. Personal Information We Collect 

We collect information that identifies, describes, or is reasonably capable of being associated with you (“Personal Information“). Personal Information does not include information that is publicly available, where permitted by law, de-identified, or aggregated as defined by applicable laws. Here are the types of information we collect about you. 

  • Identifiers, including your first and last name, e-mail address, and IP address 
  • Contact Information, including telephone number, address, e­mail address, and zip code,  
  • Vehicle data, including images of vehicles, license plate numbers, toll tag ID, vehicle make, model, year, and type, unique toll-related identifiers and gantry locations you pass through.  
  • Internet and network activity, as described in more detail in Section 2, if you visit our Website, we may collect information about your browsing and search history, interaction with our Website, and other similar information.  

2. How We Collect Your Personal Information 

We generally collect Personal Information identified above from the following categories of sources: 

  1. Directly from you, such as when you provide information through questionnaires, feedback forms, or other means.   
  2. Automatically, when you visit our Website. This includes cookies and other tracking technologies. For more information on our online tracking technologies, see the section below. 
  3. Service providers or other third parties, such as toll service providers, state transportation agencies and data-broker(s), pursuant to our agreements with these parties.   

Cookies and Other Tracking Technologies 

We use cookies and tags (which are also called web beacons, clear GIFs, pixel tags, or pixels) and other tracking technologies (collectively, “Tracking Technologies”) to track information about your use of our Website.  

  • Cookies. Cookies are small data files that are stored by your web browser when you interact with a website. When you visit a webpage, the cookie sends back Personal Information.  
  • Tags. Tags are pieces of code that can be embedded in content and ads on a webpage that track usage of our Website and effectiveness of communication. These tools can then be used to recognize our cookies and to monitor certain user interactions with a website.  
  • Do-Not-Track. Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies) 
  • Third-Party Analytics. We use automated devices and applications, such as Google Analytics to analyze and evaluate the use of the Website. Google Analytics generates statistical and other information about our Website use, including to create reports about the use of the Website and help us improve our Website’s performance and user experience. How We Use Cookies  

We use Tracking Technologies for the following purposes: 

  • Website Operation. To help us run our website securely and enable basic functions like page navigation. 
  • Performance and Analytics. To help us analyze how you interact with our Website. This enables us to monitor and improve our Website performance and your experience. 
  • Advertisements. To allow us to deliver advertisements that are meaningful to you. Our third-party advertising partners may use Tracking Technologies to build a profile of your interests, deliver relevant advertising on other sites, and measure the efficiency of the advertisements.

We use the Personal Information we collect for the following business and commercial purposes:   

  • Operating our Business and Providing Services. The main reason we use your Personal Information is to provide you with the TEXpress Lanes services you request, operate and support our Website, and otherwise run day-to-day operations.   
  • Communicating with You. We use your information to contact you by phone, fax, postal mail, or e­mail. 
  • Marketing and Advertising. We use the Personal Information we collect to provide you with marketing and advertising purposes, including our newsletters.   

You may opt out of receiving phone calls, faxes or email messages not related to the provision of the services and other promotional mailings by contacting TEXpress Lane as described in Section 5 ” Your Rights, Choices and Controls” below. You may also opt-out of e-mail communications via the SafeUnsubscribe feature, a link to which is located in our standard e-mails and newsletters.  

4. How We May Disclose Your Personal Information 

As part of providing services to you, TEXpress Lanes may share your Personal Information  for the following purposes:  

  • To Provide Our Services. We may share your Personal Information with toll service providers and state transportation agencies who perform services on our behalf, such as toll collection, payment processing, data analysis, product/service improvement, or customer services and support. Such parties may include the Texas Department of Transportation (www.txdot.gov), the North Texas Tollway Authority (www.ntta.org), and the Harris County Toll Road Authority (www.hctra.org).  
  • For Marketing and Advertising: We may share the Personal Information we collect with marketing and advertising service providers and contractors to design our marketing campaigns, render meaningful advertisements, and connect with you through social media networking. 

TEXpress Lanes does not sell, trade, rent or otherwise supply Personal , and does not process Personal Information for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the you. 

5. Your Rights, Choices and Controls 

Residents of certain U.S. states, may also have rights under applicable privacy laws, subject to certain limitations and applicability, which may include: 

  • Right to Know/Access. To confirm whether we are processing your personal data and to access your personal data. 
  • Right to Data Portability. If your personal data is available in a digital format, to obtain a copy of the Personal Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit your Personal Information to another business without hindrance. 
  • Right to Correct. To correct inaccuracies in your Personal Information, taking into account the nature of the information and the purposes for processing your Personal Information;  
  • Right to Delete. To delete your Personal Information you have provided us; 
  • Right to Opt-Out. Opt-out of certain types of processing, including: 
  • To opt out of the “sale” of your Personal Information; 
  • To opt out of targeted advertising by us; and 
  • To opt out of any automated processing of Personal Information for purposes of making decisions that produce legal or similarly significant effects. 
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your rights as described above.

For all requests, please clearly state that the request is related to “Your [State] Privacy Rights,” indicate which type of request you are making. Please provide us with the following information: (1) first and last name; (2) e-mail address; and (3) zip code. We will take steps to verify your request by matching the information provided by you with the information we have in our records. If we are unable to adequately verify a request, we will notify the requestor. 

Right to Appeal 

If we decline to take action regarding your request, you have the right to appeal our decision. We will inform you of our decision to decline, including our reasons and justification. You may submit your appeal through the same methods described above for submitting rights requests. Please clearly state in your appeal that you are appealing a declined rights request and include a description of the original request and the basis for your appeal. If we deny your appeal, we will provide a way for you to contact your state’s Attorney General to submit a complaint. 

6. Changes to this Privacy Policy 

If we change our Privacy Policy in the future, we will post the changed Privacy Policy on this page.  You will be able to determine what version of the Privacy Policy applies by the “Effective Date” placed under the title. Under certain circumstances (e.g. if we make substantial changes to this Privacy Policy), we may also elect to notify you of such changes(e.g., by e-mail or an alert on the Website for a period of time).
